Terms & Conditions
Please read these terms and conditions carefully as they incorporate the basis upon which reservations are accepted by Worrowing. Making a reservation automatically accepts all of the terms and conditions outlined hereunder.
All of our properties are private and self-contained. Worrowing also offers contactless self check-in. Guests will be sent the property address and access code via email prior to check-in. Alternatively a key and directional map will be available for collection at the Worrowing office. Our staff are available during office hours should you require assistance.
THIRD-PARTY WEBSITES
Worrowing does not accept any responsibility for misleading information that may be provided by third-party websites (Airbnb, Booking.com, etc) about any of our properties. Please contact us prior to booking if there is any feature that you would like to confirm about the property that you are interested in booking.
ABOUT US
Booking enquiries please call within office hours. Our office is open from 9am to 5pm Monday - Saturday, Sunday 9am - 1pm and closed/unattended outside of these hours. Our office is closed on Public Holidays (on call please leave a voicemail).
All In-House Guests that need emergency assistance outside of office hours can call 0484001501 and leave a voicemail (no text messages). The person in charge for the evening will listen to your voicemail and get back to you as soon as they can.
BOOKING POLICY: Check ins and outs permitted every day excluding Christmas Day. Please ensure your booking does not check in or out on Christmas Day.
ALL CHECK-INS ARE FROM 3PM
We provide self-check in at all of our properties.
ALL CHECK-OUTS ARE STRICTLY PRIOR TO 10AM
Late check-out after 10am may incur a late check-out fee up to the value of one night in your accommodation, at the discretion of management
CHILDREN
We welcome children to our accommodation however some accommodation is not child friendly (please see each room description for child friendly rooms or email us if you are not sure prior to booking). Please add children to the booking to include them in the standard tariff rate and include provision of bedding. Steps and balconies need to be taken into consideration before booking. Please note there are no baby gates or stair barriers and supervision is the responsibility of parents & guardians. Please contact management if you need further information. No refund will be given if the accommodation is deemed unsuitable after check in. Supervision of children around fireplaces, stairs, balconies, roads, driveways, bunk beds and all areas of the property and surrounds are the sole responsibility of parents/guardians and Worrowing Jervis Bay accepts no responsibility.
PORTA COTS
Porta cots can be delivered to the accommodation for $50. Guests are required to supply their own linen for this cot and it must be set up by the guest.
PETS
Unfortunately we are unable to accept pets. Strictly no pet/s on the property at any time with the exception of disability aid pets on request. Additional cleaning charges of $150 will apply if this condition is breached and will be deducted from your credit card.
Some pets are allowed at weddings only on request only and must be approved in writing.
NOISE RESTRICTIONS
Noise or unacceptable behaviour to neighbours will not be tolerated at any time. Noise means any sound that can be heard from neighbouring properties that disturbs their peace and quiet. All music must be turned off by 10pm. Anyone found playing music after 10pm will be asked to leave the property immediately and will not be accepted back onto the property.
PARTY RESTRICTIONS
Worrowing has a ZERO TOLERANCE POLICY ON PARTIES. No outside visitors are allowed unless approved by Worrowing. Any guests found with unapproved visitors and/or to be having parties will receive an automatic cancellation of their booking with no refund. Worrowing reserves the right to immediately request all occupants of the property up to, and including, the guest who has registered for the property to vacate the premises immediately.
EXTRA GUESTS
We do not accept extra guests staying above the total room occupancy in any of our accommodation. At no time during your occupancy is the number of guests staying to exceed the number booked, unless prior approval is sought and given by management in writing. The use of extra beds other than the number booked will attract an additional tariff.
Automatic cancellation with no refund will occur if guests exceed the number of people nominated at the time of booking.
EXTRA CLEANING/SERVICES
Extra charges apply for any item on the check-out checklist (provided at check-in) that is not complete upon check-out. The accommodation and yard are to be left in a clean and tidy condition. The property must be left secure with all doors and windows locked. Please ensure all dishes are washed and put back into cupboards and all rubbish is removed and placed into the appropriate rubbish bins. Failure to do so will incur a charge for extra cleaning and/or excessive rubbish removal, which will be deducted from the credit card provided at the time of booking. Extra cleaning/excessive rubbish removal will be calculated on the number of hours required over and above the normal cleaning time and/or the amount of rubbish that needs to be removed beyond the volume of the allocated bin.
NO-SHOW
Guests who do not show up for their booking will not get a refund or credit.
SMOKING
The properties are non-smoking. Smoking is permitted in some outdoor areas only with an ashtray. Strictly no smoking indoors. The guest who made the booking will be charged a cleaning fee if a smoke smell is present inside the room after departure or if cigarette butts are not in a bin.
INCLUSIONS
Variations to what is listed in the room description may apply and product brands are subject to change.
FURNITURE/FURNISHINGS
Furniture and furnishings are not to be re-arranged and must be in their original position on departure.
MOVEMENT BETWEEN UNITS
Movement of furniture within units and also between additional spaces is strictly prohibited. All items or furniture (indoor or outdoor) are exclusive to that particular accommodation and must not be moved between the spaces. In the case of multiple bookings across our accommodation, movement of any items belonging to that unit (ie. furniture, plates, cups, cushions, linen, utensils etc.) will incur additional inventory checks and housekeeping fees up to $500. If you have a large booking where extra items are required (and a function is approved in writing by management) Worrowing can supply you with hire company contact information. Any damages/excess cleaning caused by movement of items or furniture will be deducted from the bond.
VISITORS
All guests planning to have visitors must get our approval prior to the visit. Maximum of 2 visitors per studio and 1-bedroom property PER DAY and maximum of 4 visitors for our larger properties PER DAY.
OCCUPANCY RULES
The guest who booked will be held accountable for any damages and losses caused at the accommodation by them and/or their guests during the dates booked. The guest who booked will be liable for damages and losses caused (including those by third parties visiting the property) which may be subject to additional charges.
DAMAGES
All damages, breakages or losses to the accommodation, furniture and furnishings, are to be reported to the grounds manager immediately. Should the guest discover a breakage or default please advise Worrowing Office, otherwise we will consider this to be a responsibility of the current guest and you will be charged accordingly. Damages may include, but are not limited to, linen and towel replacements, carpet stains, use of candles leaving behind wax on furnishings, dirty walls, excessive cleaning, rubbish removal, and physical damage(s) to the property and/or its contents. Worrowing reserves the right to proceed with any charges in addition to the accommodation cost on the presented credit card and/or security bond supplied at the time of booking.
ROAD SAFETY
Guests are not exceed 15km/h on the gravel roads and there is strictly no off-road driving at Worrowing. Please drive with caution, as other guests and wildlife are present on the property. Automatic cancellation with no refund will occur and a charge will apply for disrespecting property if guests exceed the speed limit.
FIRES
Strictly no outside fires unless the fire is in a designated fire-pit.
No fires in Summer months (December, January and February). Fires are allowed outside of Summer months pending any restrictions at the time.
Please note fires are not permitted on high-risk fire danger days. Automatic cancellation with no refund will occur if a fire is lit outside of the designated areas or if not approved by management.
FIREWOOD
Firewood is available for purchase at the office carpark for $18 per bag (cash or charge to room). Alternatively you are welcome to collect free wood from the property grounds. You can also purchase firewood and fire-starters at the local service station (2 minutes drive).
Firewood is provided for INDOOR fireplaces only (Worrowing Houses and Cottages 1 - 5) for winter months only (May - September). Firewood can be purchased outside these months or for OUTDOOR fire pit wood can be purchased via office or at local petrol station.
CAMPING/SLEEP-OUT RESTRICTIONS
Strictly no camping in tents that are not designated Worrowing tents and strictly no sleeping-out in vehicles, campervans, motorhomes, buses, etc. Worrowing staff patrol the entire property every night and anyone found will be asked to leave the property immediately and will not be accepted back onto the property.
LOST OR DAMAGED KEYS
A fee $40 fee will be charged to your card for lost or damaged keys. If guests lose keys or lock keys inside the property and require access, a security call out fee will apply. If replacement keys need to be cut, key barrels need to be replaced, or in secure complexes, re-keying is required costs will be calculated based accordingly and charged to the guest.
LOCATION HIRE
Location hire for photoshoots and video shoots must be pre approved in writing by management. No images including the property are to be used for marketing purposes unless pre-approved in writing by our marketing team.
WILDLIFE PRESENT
Due to our rural location there can be spiders, ants, flies, insects and other small wildlife present around the accommodation.
INDEMNITY
Guests and their visitors actions, conduct and safety are the responsibility of the Guests. Worrowing Jervis Bay do not condone: unsafe, irresponsible or illegal actions/behaviour etc. on or off the premises, during a stay or at any other time. A condition of entering and/or staying at this property means that all Guests understand and agree to indemnify the agent and owners against any responsibility or action(s) (legal or other), due to any action(s), incident(s), loss or injury(s) while within or outside of the premises (including, but not limited to, the grounds, facilities, structures, etc.) during a stay or at any other time. Your booking request will be confirmed once your payment has been receipted and a receipt emailed to you following your booking confirmation.
LIMIT OF LIABILITY
Worrowing does not accept any liability whatsoever for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by any events that are out of or beyond our control. This includes but is not limited to bushfires, pandemics, air conditions and extreme weather events. No refunds for cancellations due to bushfires, pandemics, air conditions and extreme weather events. All guests are advised to have travel insurance for their stay at Worrowing Jervis Bay. All bookings are non-refundable therefore any interruption to your trip should be claimed via the travel insurance provider or credit card provider. When a guest needs to cancel their booking due to a bushfire or extreme weather event that prevents all direct access to the property, a credit for the same number of nights and same property (no monetary value) will be offered. Credits are valid for 6 months and cannot be used for bookings on public holidays and long weekends.
No responsibility is taken for guests personal property left on the premise.
The road and ground at Worrowing may be uneven. Worrowing does not accept any liability whatsoever for any injury, damage, loss, delay, additional expenses caused by road and ground that is uneven.
Worrowing is a large farm property and materials may exist on the ground in some areas. Worrowing does not accept any liability whatsoever for any injury damage, loss, delay, additional expenses caused by any materials on the ground.
Worrowing has the right to decline a booking at their own discretion.
FORCE MAJEURE
If Worrowing Jervis Bay is rendered unable wholly or in part by a Force Majeure Event to carry out its obligations then this shall not affect the operation of the terms and conditions of this agreement, and the risk of frustration is to be borne by the Customer.
SECURITY BOND
Your credit card details will be held on the system as security bond. Your credit card will be automatically debited in the event of: damage to the property, equipment, breakages or if extra cleaning is required. Please note: we will only process monies on your credit card or if there is reported damage to the Property, or if the 'Terms and Conditions' are not adhered to.
WORROWING ACCOMMODATION
GENERAL TERMS & CONDITIONS
BACKGOUND
Worrowing Jervis Bay (ABN 65 060 683 632) shall be referred to as “Worrowing”, “we”, “us”, or “our”.
In these Terms, “you”, “your” or “Customer” shall refer to you as the personal, natural or legal, who is making the Booking, any Guests, and if you are making a Booking as an authorised agent of and on behalf of an organisation, company or third party, “you” or “your” shall refer to that organisation, company or third party, of which these Terms will be deemed to bind.
Please read these Terms, any additional notices and disclaimers, and our Privacy Policy carefully as they govern and apply to all and any use, access and availability of our Accommodation Services. Please review our Privacy Policy which can be found on our Website to learn more about how we use any information you provide about yourself.
1. DEFINITIONS AND INTERPRETATION
1.1 Definitions
For the purpose of these Terms, unless the contrary intention appears:
Accommodation means the accommodation located at the Premises which is hired to you and the Guests on the terms included herein.
Accommodation Rules means the rules the Customer must abide by at the Accommodation, including but not limited to any rules displayed on the Website, on the Premises, and those in these Terms.
Accommodation Services means the services provided by Worrowing to the Customer at and in relation to the Accommodation and related services.
Arrival Date means the date from which the Accommodation will be provided to you and the Guests.
Australian Consumer Law means the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
Booking means the Booking made by you for the Accommodation for a period of time from the Arrival Date as specified in the Booking confirmation document.
Business Day means Monday to Friday (inclusive) not including Public Holidays.
Customer means the person, natural or legal, who is making the Booking, their servants, agents, contractors, subcontractors, and invitees.
Events Agreement means the agreement between Worrowing and a customer to hold an event at the Premises.
Fee means the price payable for your booking at the Accommodation.
GST has the meaning given by sub section 195.1 of the A New Tax System (Goods and Services Tax) Act 1999.
Guests means the persons who will occupy the Accommodation in accordance with these Terms.
Incidental Charges means charges that may be incurred by customers from time to time, including but not limited to telephone charges, room services, bedding fees, parking fees, mini-bar or other charges.
Premises means 81 The Wool Road Worrowing Heights, NSW 2540.
Public Health Order means an order made by the Minister for Health and Medical Research under the Public Health Act 2010 (NSW).
Terms means the terms and conditions herein contained in this document, and any amendments thereto made by Worrowing from time to time.
Website means the Worrowing website operating under the domain name <<https://www.worrowing.com.au/>>.
1.2 Interpretation
In these Terms:
(a) headings are included for convenience only and do not affect interpretation;
(b) references to Customer includes its servants, agents, subcontractors, Guests and invitees; and
(c) all rates quoted are in Australian currency.
2. CAPACITY
You represent and warrant to us as follows:
(a) you have the legal capacity to understand and enter these Terms and our Privacy Policy; and
(b) you are of at least 18 years of age.
3. ACCOMMODATION SERVICES
3.1 General
(a) All Accommodation is self-contained and is self-check in (entry via lockbox code).
(b) Our staff are available during office hours 9am to 5pm (“Opening Hours”). We are closed and the office is unattended outside of the Opening Hours.
(c) All Guests that need urgent assistance outside of office hours can call 0484 001 501 and leave a voicemail (no text messages). The duty manager for the evening will will get back to you as soon as they can. All non-urgent enquiries will be assisted during office hours. We will always do our best to help.
3.2 Use
(a) The Accommodation is to be used for holiday accommodation only. It is not to be used to hold a party, group gathering, wedding ceremony, reception or any other function or event unless agreed with us in writing. The Accommodation at Worrowing Estate is available for such use under a separate Events Agreement.
(b) The Accommodation (in part or whole) must not be sublet without our prior written consent.
4. WEBSITE POLICY
(a) The Customer acknowledges that although every reasonable effort is used to make sure that all materials such as photographs and images displayed on the Website accurately reflect the Accommodation, such materials are to be used as a guide only and variations may occur due to renovations, refurbishments etc.
(b) For more information regarding the Accommodation, Customers are encouraged to visit and inspect the Accommodation to ensure that the Booking fits the Customer’s particular purpose.
(c) To the fullest extent permitted by law (including the Australian Consumer Law), Worrowing does not accept any responsibility for misleading information that may be provided by third-party websites (for example, Airbnb, Booking.com, etc.) about the Accommodation. Please contact us prior to Booking if there is any feature that you would like to confirm about the Accommodation that you are interested in Booking.
5. BOOKING AND QUOTES
(a) Bookings can be made over the internet via the Website.
(b) We have the right to decline a Booking at our absolute discretion.
(c) The Accommodation may be occupied only by the stipulated number of Guests for the period stated on the Booking confirmation.
(d) Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of the Booking.
6. PAYMENT OPTIONS
(a) We accept payment via Visa or MasterCard and Amex. A surcharge will apply which you will be notified of at the time of payment.
(b) All payments are only accepted in Australian dollars.
7. RATES AND CHARGES
(a) Rates quoted are in Australian dollars and are subject to change at any time. Worrowing is not liable for and is not required to honour any pricing displayed that is quoted in error on its Website or any third party sites. A cancellation under these circumstances does not incur any cancellation fee. Rates are inclusive of GST where applicable.
(b) Minimum length of stay restrictions apply to certain dates during peak holiday season, public holidays and special event periods as determined by Worrowing from time to time in its absolute discretion.
(c) Full payment is required and will be processed at the time of Booking to secure your dates.
(d) If payment is not received at the time of Booking, Worrowing reserves the right to cancel the Booking.
(e) If a Booking is taken based on incorrect rates or where a property is unavailable, we reserve the right to cancel the booking or re-offer it to you at the correct rate. Technical issues are rare, but they do occur.
8. SECURITY DEPOSIT
The Customer authorises Worrowing to automatically debit its credit card saved on the system in accordance with clause 10 in the event of the following:
(a) damage to the room and any property or equipment located within the room and outside the room (i.e. outdoor furniture and garden etc.);
(b) breakages, missing items, damage to the property charged at replacement or repair value plus delivery and installations costs; or
(c) it is clear that either the property or neighbours have not been respected or a call out is required;
(d) if extra cleaning is required because the property has not been left in a tidy state.
9. INCIDENTAL CHARGES
(a) The price paid at Booking does not include Incidental Charges.
(b) The Customer shall be responsible for any Incidental Charges incurred and which remain outstanding at check-out, including but not limited to:
(i) Excess cleaning requirements: charged at $55/hr;
(ii) Dirty barbeque: $100
(iii) Late departure: $50 per hour until 1pm, or late check-outs after 1pm will incur 100% of the nightly rate on the day of departure;
(iv) Missing keys: cost of changing of the locks/re-coding and replacement of keys;
(v) Missing garage remote controls: the cost of re-coding and replacing the remote control;
(vi) Breakages, missing items, damage to the property charged at replacement or repair value plus delivery and installations costs;
(vii) Extra guests beyond those declared: $100 per guest per night.
(viii) Electric Vehicle charging at accommodation: $6 per day.
9.2 The Customer authorises Worrowing to deduct Incidental Charges from the credit card saved on the system immediately at or after check-out.
9.3 Details of the Incidental Charges, if any, shall be provided to the Customer immediately at or after check-out or else as soon as practicable thereafter.
10. STORAGE OF YOUR DETAILS
(a) Your personal information is transmitted via an encrypted connection and stored by Worrowing. Please see our Privacy Policy for more details, which is available on our Website.
(b) Your credit or debit card information is stored by our payment processor so that we can process your payment and automatic debit pursuant to these Terms (if applicable).
(c) Your details will be transmitted to our payment processor via Payment Card Industry Data Security Standards (PCI-DSS) compliant protocols. Our payment processor is responsible for protecting the security of credit or debit card details stored on their servers, and will take reasonable steps to protect your personal information from unauthorised access and accidental loss or modification.
11. REFUND AND CANCELLATION POLICY
11.1 Cancellation by you
(a) The Customer acknowledges that, if the Customer cancels a Booking, Worrowing may suffer the following loss and damage, depending on the timing of the cancellation, including but not limited to:
(i) loss of opportunity for Worrowing to secure another replacement accommodation Booking/s, wedding booking, conference booking and other related event Bookings;
(ii) administration charges in preparing the group accommodation Bookings, weddings, conferences and other related event Bookings; and/or
(iii) administration and advertising costs of reselling accommodation Bookings.
(b) Subject to the Customer’s rights under the Australian Consumer Law, the following cancellation policy applies:
(i) We will refund you 90% of the Fee of the Booking when you cancel the Booking with more than 90 days written notice prior to the Arrival Date.
(ii) We will refund you 50% of the Fee of the Booking when you cancel the Booking with at least 30 days written notice prior to the Arrival Date.
(iii) We will not provide any refunds for Bookings cancelled within 30 days of the Arrival Date.
(iv) We do not accept any changes to Bookings within 30 days of the Arrival Date.
(c) Customers who do not show up for their Booking will not be refunded and forfeit their Booking and the Fee.
(d) Refunds will not be provided for shortened stays, change of mind or if accommodation is deemed unsuitable after check-in.
(e) If you find something not quite right on arrival to your accommodation, please let our staff know via phone or email so that we can do our best to solve any issues or send our housekeeping team to your accommodation. We always try to do our best to ensure our guests enjoy their stay. Refunds will not be provided for any bookings if Worrowing has not been advised of any issue prior to departure.
(f) All Bookings are subject to the COVID-19 policy set out in clause 21.
(g) All Wedding/Event related Accommodation bookings are non-refundable. Please refer to the Event contract.
(h) All Guests are advised to have travel insurance for their stay at the Accommodation. Any interruption to your trip should be claimed via the travel insurance provider or credit card provider.
(i) When a Customer needs to cancel their Booking due to a bushfire or extreme weather event that prevents all direct access to the property, a credit for the same number of nights and same property (no monetary value) will be offered. For the avoidance of doubt, no refund will be provided in this instance. Credits are valid for 6 months and cannot be used for Bookings on peak holiday periods, public holidays and long weekends.
(j) Although we will be as flexible as possible, refunds are not permitted for certain circumstances including but not limited to:
(i) A change of travel plans;
(ii) Disruptions to transportation to the property;
(iii) Illness;
(iv) A lack of access to attractions (such as Booderee National Park, wineries, Jervis Bay) due to factors beyond our control (such as bushfire, inclement weather, worker’s strike etc); and
(v) Forecast weather or other environmental impacts (such as rain, smoke haze, extreme heat or cold, high winds, bushfire, floods etc) where they do not directly impact your ability to access the property.
11.2 Cancellation by us
(a) We may cancel the Booking if you have not paid us for the Accommodation in accordance with these Terms.
(b) We may in certain unforeseen circumstances have to cancel the Booking and if this occurs we will notify you in writing as soon as possible and confirm the cancellation in writing within 3 days. If you have paid any sums to us in advance of such cancellation we will refund the full sum to you with the written notice of cancellation or you may elect to change your Booking to an alternative date in which case we will send you an amended Booking confirmation specifying the new Arrival Date.
(c) Worrowing is not responsible for finding alternative accommodation for you or your Guests in the event your Booking is cancelled.
12. CHECK IN AND CHECK OUT
(a) The Customer agrees to check-in no earlier than 3pm on the first day of the Booking.
(b) We use a self check-in procedure as follows:
(i) A directional map and access code will be available to collect from the Worrowing office (for Worrowing Estate Accommodation only); or
(ii) The Customer will be sent the property address and access code via email prior to check-in (Villas of Huskisson, Beachfront House, Nelsons Cottage, Nelsons Studio).
(c) The Customer agrees to check-out no later than 10am on the morning after the final night of the Booking.
(d) The time of arrival and departure is enforced as we often have back to back bookings.
(e) Early check-ins or late checkouts may be arranged with us prior or during your Booking (at our absolute discretion).
(f) Check out time is strictly 10am unless previously arranged with a late departure fee of $50 per hour until 1pm. Late check-outs after 1pm will incur a full night fee. Additional charges will be at our discretion for failure to comply.
13. DEPARTURE AND CLEANING
(a) The premises, accommodation and yard/grounds are to be left in a clean and tidy condition.
(b) The Accommodation must be left secure with all doors and windows locked.
(c) Worrowing will provide a check-out checklist to all guests. Extra charges may apply for any item on the check-out checklist that is not complete upon check-out.
(d) Please ensure all dishes, glasses, pots and pans are washed and put back into cupboards, otherwise a cleaning fee of $55 will apply.
(e) Please ensure the BBQ is cleaned thoroughly and left tidy otherwise a cleaning fee of $100 cleaning fee will apply.
(f) No furniture, plants, objects or otherwise are to re-arranged or moved from their positions in or around the Accommodation. A $100 fee shall apply if any items have been moved from their original positions.
(g) Where any other extra cleaning is required it will be charged to the credit card provided at the time of Booking and calculated on the number of hours required over and above the normal cleaning time at a rate of $55 per hour.
14. RUBBISH REMOVAL
(a) We provide a limited number of bins for rubbish.
(b) You are responsible for ensuring all rubbish is placed within the bins provided. Where the rubbish bins are full you are responsible for removing the excess rubbish from the Premises.
(c) We reserve the right to charge you for costs to collect and remove excess rubbish (including any rubbish that does not fit within the bins provided) from the Premises at hourly rates of $55 plus transport and tip fees.
15. DURING YOUR STAY
15.1 Behaviour
You must respect and preserve the residential amenity of the Premises. No drunken, obscene or antisocial behaviour is permitted on the Premises.
15.2 Noise Restrictions
Noise or unacceptable behaviour to neighbours will not be tolerated at any time and is strictly prohibited. Noise means any sound that can be heard from neighbouring properties that disturbs their peace and quiet. All music must be turned off by 10pm. Anyone found playing music after 10pm will be asked to leave the Premises immediately and will not be accepted back onto the Premises.
15.3 Party Restrictions
Worrowing has a strict zero tolerance policy when it comes to parties. Disturbance to neighbours, including excessive noise, is prohibited and will result in termination and eviction without refund and extra charges may be made for security and other expenses. No outside visitors are allowed unless approved by Worrowing. Any Guests found with unapproved visitors and/or to be having parties will receive an automatic cancellation of their Booking with no refund. Worrowing reserves the right to immediately request all occupants of the property up to, and including, the guest who has registered for the property to vacate the premises immediately. All costs relating to the termination and eviction will be borne by you and you will be liable for a penalty equivalent to the security bond.
15.4 Call out
If we are called to or need to attend your accommodation due to a breach of any of the obligations in this Accommodation Policy, then you shall be charged a fee of $500.
15.5 Extra Guests
(a) We do not accept extra Guests staying above the total room occupancy in any of our accommodation. At no time during your occupancy is the number of Guests staying to exceed the number booked, unless prior approval is sought and given by management in writing.
(b) The use of extra beds other than the number booked will attract an additional tariff of $100 per person, per night. Automatic cancellation with no refund will occur if Guests exceed the number of people nominated at the time of Booking, or the amount will be charged to the Guest.
15.6 Children
(a) We welcome children to the Accommodation, however some accommodation is not child friendly. Please see each room description for child friendly rooms or email us if you are not sure prior to Booking.
(b) Please add children to the Booking to include them in the standard tariff rate and include provision of bedding. Steps and balconies need to be taken into consideration before Booking.
(c) There are no baby gates or stair barriers and supervision is the responsibility of parents and guardians. Supervision of children around fireplaces, stairs, balconies, roads, driveways, bunk beds and all areas of the Premises and surrounds are the sole responsibility of parents and guardians and Worrowing accepts no responsibility.
(d) Children under the age of 12 must be supervised at all times.
(e) No refund will be given if the accommodation is deemed unsuitable after check-in.
15.7 Porta Cots
Porta cots can be delivered to the accommodation for $50. Guests are required to supply their own linen and towels for this cot and it must be set up by the guest.
15.8 Visitors
All Guests planning to have visitors must get our approval prior to the visit. Maximum of 2 visitors per studio and 1-bedroom property per day and maximum of 4 visitors for our larger properties per day.
15.9 Pets
(a) Pets are not permitted at any time at the Accommodation or Premises with the exception of disability aid pets on request.
(b) A charge of $250 will apply if this condition is breached and will be deducted from your credit card.
15.10 Bedding
(a) Linen is provided for queen beds and single beds to match the number of Guests in the Booking. Guests must bring their own cot linen and towels for infants.
(b) We do not provide extra bedding, mattresses and linen for additional Guests that is above the number of beds provided in the accommodation.
15.11 Towels
(a) Worrowing provide bath towel, bath mat, hand towel and tea towel.
(b) We can provide fresh bath towels upon request for a small laundry charge of $5 per towel. Please call or email during office hours to arrange collection from the office.
(c) Please bring your own beach towels.
15.12 Housekeeping
As we are a small business operating self-contained private accommodation, we do not provide a house keeping service, unless pre-arranged with Worrowing in writing.
15.13 Smoking
(a) In the interest of public health, and in line with Government Regulations, Worrowing is a smoke free Premises. Smoking is strictly prohibited.
(b) A $500 cleaning fee will be charged to any guest who violates the smoking policy.
(c) If there is any evidence of smoking inside, your Booking may be terminated and you will be charged for a specialised clean, up to $1,000, to eliminate odours.
15.14 Furniture/Furnishings
Furniture and furnishings are not to be re-arranged and must be left in their original position on departure. Please do not move indoor furnishings outdoors.
15.15 Movement Between Units
(a) Movement of furniture within units and also between additional spaces is strictly prohibited. All items or furniture (indoor or outdoor) are exclusive to that particular accommodation and must not be moved between the spaces.
(b) In the case of multiple Bookings across our accommodation, movement of any items belonging to that unit (ie. furniture, plates, cups, cushions, linen, utensils etc.) will incur additional inventory checks and housekeeping fees from $500. If you have a large Booking where extra items are required (and a function is approved in writing by management) Worrowing can supply you with hire company contact information. Any damages/excess cleaning caused by movement of items or furniture will be charged to the credit card provided.
15.16 Road Safety
Guests are to not exceed 15km/h on the gravel roads and there is strictly no off-road driving at Worrowing. Please drive with caution, as other Guests and wildlife are present on the Premises. Automatic cancellation with no refund will occur and a charge will apply if Guests exceed the speed limit.
15.17 Firewood
Firewood is provided for indoor fireplaces for winter months only (May - September).
Firewood is not provided for outdoor fire pits.
Firewood.is available for purchase at the office for $17 per bag (cash or charge to room). You are welcome to collect kindling from the property grounds. You can also purchase firewood and fire-starters at the local service station (2 minute drive).
15.18 Outdoor Fire Pits
(a) Strictly no outside fires unless the fire is in a designated fire-pit.
(b) Fires are not permitted in Summer months (December, January and February) due to fire bans and safety, unless otherwise approved by Worrowing management.
(c) Fires are permitted outside of Summer months pending there are no any fire bans/restrictions at the time.
(d) Fires are not permitted on high-risk fire danger days. Automatic cancellation with no refund will occur if a fire is lit outside of the designated areas or if not approved by management.
15.19 Fireplaces/Firepits
(a) Fireplaces are to be operated by adults over the age of 18 only and are operated at your own risk. You will be held liable for any damage you cause including smoke or ember damage from incorrect use.
(b) If using a wood or gas fire, you will ensure the fire is switched off or put out entirely whenever you leave the Accommodation even for short periods. Supervision of children around all fireplaces is required and is the responsibility of parents/guardians.
(c) All fireplaces and their external casings can get very hot and may cause serious burns if touched. It is strongly recommended that the fireplaces not be operated when children are staying onsite.
15.20 Camping/Sleep-Out Restrictions
Camping in tents, sleeping-out in vehicles, campervans, motorhomes, buses, etc is strictly prohibited at Worrowing. Worrowing staff patrol the entire Premises every night and anyone found breaching these Terms will be asked to leave the Premises immediately. A fee of $1,000 will be applied to the Guest breaching these Terms.
15.21 Lost or Damaged Keys
(a) A $30 fee will be charged to your card for lost or damaged keys. If Guests lose keys or lock keys inside the property and require access, a security call out fee of $200 will apply.
(b) If replacement keys need to be cut, key barrels need to be replaced, or in secure complexes, re-keying is required costs will be calculated based accordingly and charged to the guest.
15.22 Location Hire
Location hire for photoshoots and video shoots must be pre-approved in writing by Worrowing. No images including the Premises are to be used for marketing purposes unless pre-approved in writing by our marketing team.
15.23 Wildlife Present
Due to our rural location there can be spiders, ants, flies, ticks, insects and other small wildlife (possums, birds, wallabies and kangaroos) present around the accommodation. Some accommodation is near water and there are frogs present.
15.24 Inspections
We may conduct inspections of the Premises inspections, wedding inspections and client tours during your stay. This will be done with minimum impact to you and we will not inspect the inside of accommodation while in use.
15.25 Future Construction
(a) The Premises is constantly being upgraded and developed. We cannot guarantee exact time lines, inclusions or exclusions.
(b) We take every care to minimise the look of incomplete construction and ensure the Premises is tidy for your stay.
15.26 Occupancy Rules
The Customer will be held accountable for any damages and losses caused at the accommodation by them and/or their Guests during the dates booked. The Customer will be liable for damages and losses caused (including those by third parties visiting the property) which may be subject to additional charges.
15.27 Damages
(a) The Accommodation must be returned to us in the condition presented on the Arrival Date.
(b) All damages, breakages or losses to the accommodation, furniture and furnishings that are caused by any guest and/or a guest’s visitor will be charged and recouped in full from the Customer’s credit card.
(c) Should the guest discover a breakage or default please advise the Worrowing Office immediately, otherwise we will consider this to be a responsibility of the current guest and you will be charged accordingly.
(d) Damages may include, but are not limited to, missing items, linen and towel replacements, fake tan stains, carpet stains, use of candles leaving behind wax on furnishings, dirty walls/floors, excessive cleaning, rubbish removal, and physical damage(s) to the property and/or its contents.
15.28 Inclusions
Variations to what is listed in the room description may apply and product brands are subject to change.
16. COMPLIANCE WITH LAW AND ACCOMMODATION RULES AND POLICIES
Customer agrees to comply with all applicable federal, state and local laws and Accommodation Rules and policies, including but not limited to those in clause 15 and the Code of Conduct for the Short-term Rental Accommodation Industry (if applicable).
17. SECURITY AND SAFETY
(a) We make no guarantees about the security of the Premises and you are responsible for the security of your accommodation including all items within the accommodation during your stay. In the event of any equipment being stolen, you must notify us in writing stating the full circumstances of the theft and the time the police were notified. No responsibility is taken for guest’s personal property left on the Premises.
(b) The Customer acknowledges on its own behalf and on behalf of its servants, agents, subcontractors and invitees that Worrowing is not responsible for any loss or damage to any equipment, merchandise or other personal property left at the Accommodation during a Booking, or before, during or after an event.
(c) If Worrowing, in its reasonable judgment, is of the view that the booking or Customer’s Guests or invitees may jeopardise the smooth operation of Worrowing’s business, its security or reputation, Worrowing reserves the right to remove any disruptive individuals or cancel the booking if necessary.
18. STATUTORY GUARANTEES AND LIMITATION OF LIABILITY
18.1 To the fullest extent permitted by law (including the Australian Consumer Law), we exclude all other rights, remedies, guarantees, conditions and warranties in respect of your use and access of the Accommodation Services, use and access of the Accommodation, access to our Website, whether based in statute, common law or otherwise to the extent permitted by law. Subject to the Australian Consumer Law and to the fullest extent permitted by law:
(a) we exclude all liability for any direct, indirect, special and/or consequential damages arising from the use and access of the Accommodation Services, Accommodation and Website in respect to any:
(i) events that are out of or beyond our control;
(ii) bushfires, pandemics, air conditions and extreme weather events;
(iii) damage to guest’s personal property, including personal property left on the Accommodation;
(iv) road and ground that is uneven;
(v) materials on the ground, noting that the Accommodation is a large farm property;
(vi) any breach of health advice or government-imposed restrictions by the Customer or Guests;
(vii) failure of the Customer or Guests to maintain travel insurance;
(viii) cancellations to the Booking for whatever reason or interruptions to the Customer’s trip;
(ix) the Customer’s use of the Accommodation;
(x) personal injury or property damage, of any nature whatsoever, resulting from access to and use of the Accommodation; and
(xi) interruption of business or any consequential or incidental damages.
(b) you warrant that any information you have provided to us is true and correct and we disclaim all liability for any loss or damage that you may suffer or incur in the event of incorrect or incomplete information having been supplied;
(c) upon our request, you agree to defend, hold harmless and indemnify us and each of our affiliates, directors, officers, employees and agents against any action, claim, loss or expense (including reasonable legal fees) incurred by us, which arises from or in connection with your access or use of the Website, Accommodation and Accommodation Services;
(d) you indemnify Worrowing against claims, losses, actions, damages, costs and expenses, personal injury, death or damage to property arising from the Customer’s and Guests’ use of the Premises and Accommodation or any other person directly or indirectly associated with the Customer’s and Guests’ use of Premises and Accommodation or by the Customer’s or Guests’ failure to comply with these Terms; and
(e) we reserve the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defence of such claim.
18.2 To the extent that our liability for breach of any implied warranty or condition cannot be excluded at law, our liability will be limited, at our option to the supply of the services again or the payment of the cost of having the services supplied again.
18.3 In relation to any express warranty or condition set out in these Terms in connection with goods or services supplied or offered by us or any of our related entities, our liability shall be limited to the amount paid by you for the Accommodation Services.
19. FORCE MAJEURE
Worrowing and its affiliates will not be liable or deemed to be in default for any delay or failure in performance or interruption of the performance of its obligations under these Terms, including but not limited to providing Accommodation Services, that may result directly or indirectly from any cause or circumstance beyond its or their reasonable control, including but not limited to failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, computer viruses, epidemics or pandemics, embargoes, unauthorised access, theft, operator errors, severe weather, earthquakes or natural disasters, strikes or other labour problems, wars, or governmental restrictions.
20. PRIVACY
(a) Customer acknowledges on its own behalf and on behalf of its Guests that Worrowing is entitled to collect information about the Customer and its Guests for administrative purposes and to enable Worrowing to ensure that the Accommodation Services are provided as efficiently as possible. We will otherwise handle your personal information in accordance with our Privacy Policy, which is available on our Website.
(b) By providing your personal information, you agree to the terms of our Privacy Policy.
(c) After the completion of the Accommodation Services, Worrowing may request Customer to complete a questionnaire about the Accommodation Services and provide that questionnaire to Worrowing.
21. COVID-19 POLICY
(a) All Guests and Customers must comply with any Public Health Orders and any advice or direction from NSW Health, the Minister for Health and Medical Research or the NSW Government at the time of their Booking and during the Hire Period, including but not limited to COVID safe check-in, capacity limits and square metre rules and producing proof of vaccination (if required) (COVID-19 Orders).
(b) Worrowing will not be held liable for any penalties incurred due to Customers or Guest’s breach of COVID-19 Orders.
(c) Should your Booking be affected by a COVID-19 Order, we offer flexibility in our terms and conditions to allow Customers to postpone their stay, however a refund will not be offered.
(d) COVID-19 AFFECTED BOOKINGS: Should a COVID-19 Order, international or interstate travel restriction or other government mandated restriction be enforced that prevents you from travelling on your booked date, we will use reasonable endeavours to postpone your Booking to a future date within 6 months, with no penalty. This does not include peak summer and Easter holiday periods, Public Holidays and Long Weekends. In some cases, mid-week dates may only be offered/available. If you do not have a future date in mind, we will offer a credit for the same Accommodation and same number of booked nights to be used within 6 months. No date extensions will be permitted.
(e) GUESTS WISHING TO CANCEL THEIR STAY ENTIRELY: Guests will be subject to our standard cancellation policy terms and conditions.
(f) COVID-19 CREDIT NOTES: For all change of date and postponed stays, Bookings are subject to the rates at the time of new bookings. Therefore, if Customers are moving dates from a low season to a high season, Customers will be required to pay the difference at the time of postponing their booking to secure new dates. Refunds will not be offered for bookings moved from high season to low season (the same number of booked nights applies). Credits can only be used for one booking at one property and cannot be used for split bookings or multiple bookings at multiple properties.
22. UPDATES TO THE WEBSITE AND SERVICES
(a) Worrowing reserves the right to modify, improve, make any other changes to, or discontinue, temporarily or permanently the Website without notice, at any time.
(b) If Worrowing supplies to you any updates, upgrades and any new versions of the Website (“Updates“) according to its then current policies, it may include automatic updating or upgrading of the Website with or without any additional notice to you and the Terms will govern any such Updates unless these are accompanied by a separate license agreement which will prevail, and all references herein to the Website shall include such Updates. For clarity, Worrowing has no obligation to provide Updates.
23. DISPUTES
(a) A party must not commence legal proceedings (except proceedings seeking interlocutory relief) in respect of a dispute arising out of these Terms unless it has complied with this clause. A party claiming that a dispute has arisen must notify the other party to the dispute giving details of the dispute.
(b) During the 15-Business Day period after notice is given (or any longer period agreed in writing by the parties to the dispute) (“Initial Period”) each party to the dispute (“Disputant”) must cooperate and take all reasonable steps necessary to resolve the dispute.
(c) If the Disputants are unable to resolve the dispute within the Initial Period, each Disputant agrees that the dispute must be referred for mediation to a mediator agreed on by the Disputant.
(d) If the Disputants are unable to agree on a mediator within 7 days after the end of the Initial Period, then the parties must submit the dispute for mediation through the Law Society of New South Wales and have the president of that law society appoint a mediator and set the matter for mediation.
(e) The role of the mediator is to assist in negotiating a resolution of the dispute. A mediator may not make a decision that is binding on a Disputant unless that Disputant has so agreed in writing.
(f) Each Disputant must pay its own costs of complying with this clause. The Disputants must pay equally the costs of any mediator engaged.
(g) The mediation will be held in New South Wales, Australia.
(h) After the Initial Period, a Disputant that has complied with this section may terminate the dispute resolution process by giving notice to each other Disputant. A party to a dispute will only be entitled to pursue other remedies available to it at law or otherwise, if the parties have failed to resolve the dispute within 30 Business Days after commencement of dispute resolution.
(i) All communications concerning negotiations made by the Disputants in connection with this dispute resolution clause are confidential and, to the extent possible, must be treated as “without prejudice” negotiations for the purpose of applicable law of evidence.
24. MISCELLANEOUS
(a) These Terms will be governed by and interpreted in accordance with the laws of New South Wales, Australia.
(b) If any part of these Terms is found to be void, unlawful or unenforceable then that provision will be deemed to be severable from these Terms and the severed part will not affect the validity and enforceability of the remaining Terms.
(c) A failure to exercise or enforce any right or provision under these Terms will not constitute a waiver of such right. Any waiver will only be effective if done in writing by Worrowing.
(d) Other than as expressly set out in these Terms, no party has relied on any representation made by or on behalf of the other.
25. NOTICES
Any notice required or permitted by these Terms must be in writing. Notice may be sent via facsimile transmission or email and will be considered effective as of the date and time of the facsimile confirmation of transmission or of email received.
26. INCONSISTENCY
The parties acknowledge and agree that these Terms shall take precedence and prevail over any other terms and conditions, except for the Worrowing Event Terms and Conditions, whether imposed by the customer or any other third party.
Payment Policy
Full payment is required and will be processed at time of booking to secure your dates. We do not offer refunds.
If payment is not received by the due date, Worrowing Jervis Bay reserves the right to cancel the booking.
Rates quoted are in Australian dollars and are subject to change at any time. Worrowing is not liable for and is not required to honour any pricing displayed that is quoted in error. A cancellation under these circumstances does not incur any cancellation fee. Rates are inclusive of GST where applicable. Any verbal quote given is an estimate only of price, which will be subject to a written advice on confirmation of the booking. Minimum length of stay restrictions apply to certain rates during special event periods.
Preferred method of payment is Visa, MasterCard - a 1.95% surcharge applies for these card transactions.
Amex is also accepted and a 3% surcharge applies for these card transactions.
SECURITY BOND
Your credit card details will be held on the system and your credit card will be automatically debited in the event of: damage to the property, equipment, breakages or if extra cleaning is required. Please note: we will only process monies on your credit card or if there is reported damage to the Property, or if the 'Terms and Conditions' are not adhered to.
